RESOLUTION TO APPROVE 12TH AMENDMENT TO WATER
PURCHASE CONTRACT WITH DEAN DALE WATER SUPPLY
CORPORATION
WHEREAS, the City of Wichita Falls and Dean Dale Water
Supply Corporation entered into a Water Purchase Contract on
March 2, 1977, said contract being for a term of 40 years from
the date of initial metering of water;
WHEREAS, Dean Dale Water Supply Corporation is seeking to
make certain improvements in its distribution system and is to
fund the improvements from a loan by the Farmer' s Home
Administration;
WHEREAS, a provision of the loan from Farmer' s Home
Administration is that the contract between the City of Wichita
Falls and Dean Dale Water Supply Corporation be for a 40-year
term from the start of the loan period;
WHEREAS, Dean Dale Water Supply Corporation through its
consulting engineer has requested that the existing contract be
extended for 18 years beyond the current expiration date to allow
time for completion of the construction of the improvements and a
40-year term after the improvements are completed;
WHEREAS, the City of Wichita Falls is requesting certain
modifications of the contract regarding the Air Installation
Compatible Use Zone for Sheppard Air Force Base to control
development that could adversely affect aircraft operations at
SAFE; and,
WHEREAS, the Council has examined a proposed 12th Amendment
to the Water Purchase Contract for the stated purposes .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The 12th Amendment to the Water Purchase Contract between
the City of Wichita Falls and Dean Dale Water Supply Corporation
is hereby approved, and the City Manager is authorized to execute
the Amendment for the City.
