RESOLUTION TO APPROVE LETTER OF UNDERSTANDING
AND WATER CONTROL AGREEMENT FOR LAKE KEMP DAM
AND RESERVOIR
WHEREAS, the City of Wichita Falls and Wichita County Water
Improvement District No. 2 jointly own the Lake Kemp dam and
reservoir system;
WHEREAS, the federal government invested in the 1974
renovation of the dam and spillway at Lake Kemp;
WHEREAS, the federal government through the U. S. Army Corps
of Engineers now controls the operation of the Lake Kemp dam and
reservoir when the water level in the lake exceeds the
conservation storage level, said federal control being for flood
control purposes;
WHEREAS, federal law directs the Secretary of the Army to
prescribe regulations for the use of water stored for flood
control purposes when the storage facility is constructed wholly
or in part with federal funds;
WHEREAS, in implementing this federal law, the U.S. Army
Corps of Engineers maintains a Water Control Manual on each such
flood control facility, and the Water Control Manual includes a
Letter of Understanding and Water Control Agreement between the
facility owners and the U.S . Army Corps of Engineers;
WHEREAS, the City and Water District staffs have coordinated
such a Letter of Understanding and Water Control Agreement with
the U. S. Army Corps of Engineers; and,
WHEREAS, the Council has examined the proposed Letter of
Understanding and Water Control Agreement for the Lake Kemp dam
and reservoir system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Such Letter of Understanding and Water Control Agreement
between the City, Water District, and U.S. Army Corps of
Engineers is hereby approved, and the City Manager is authorized
to execute the same for the City of Wichita Falls .
