Res 144-94 9/6/1994RESOLUTION NO. t LL d /LI A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ACCEPTING BID ON EXCESS CITY PROPERTY AT 605 R EDWARDS STREET AND AUTHORIZING THE MAYOR TO EXECUTE THE DEED TO CONVEY TITLE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the 7.27 acre tract of excess property known as 605 R Edwards Street has been advertised for sale to the general public; and, WHEREAS, sealed bids were opened on August 29, 1994, which were submitted by two bidders who desire to purchase said property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The following parcel of landlocked real property located in Wichita Falls, Wichita County, Texas, has been identified as excess and has been advertised for sale to the public by sealed bid: A 7.27 acre tract, more or less, out of Block 1, Kemp and Newby Subdivision of the southwest quarter of the J. A. Scott Survey, A-299, also known as 605 R. Edwards Street. SECTION 2. The following bids for the above-described tract were opened on August 29, 1994: Steve A. Nielsen 2, 000. 00 918 East Ft. worth Wichita Falls, Texas Leroy Reeder 1, 600. 00 706 Suburban Wichita Falls, Texas SECTION 3 . The above-listed high bid of Mr. Steve A. Nielsen is hereby accepted, and the Mayor is authorized to execute the special warranty deed which is attached hereto.P Y SECTION 4. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. Nielsen, 918 East Forth Worth Street, Wichita Falls, Texas, all of the following described real property in Wichita County, Texas, to-wit: Being a tract of land out of Block 1, Kemp and Newby Subdivision, of the Southwest quarter of the J. A. Scott Survey, A-299, Wichita County, Texas, and being described by metes and bounds as follows: BEGINNING at a point, said point being the intersection of the South line of said Block 1 and the East right-of-way line of Holliday Creek, said point bears South 89° 29' 11" East, 415.56 feet from the Southwest corner of said Block 1 and is the place of beginning; THENCE North 03° 28' 30" East, leaving said South line of Block 1 and along said East right-of-way line of Holliday Creek, a distance of 31.58 feet to a point, said point also being the beginning of a curve to the left, having a radius of 1, 074.94 feet and a central angle of 21° 27' 02"; THENCE in a northwesterly direction along said curve to the left and continuing along said East right-of- way line of Holliday Creek, an arc distance of 402 .44 feet to a point; THENCE North 72° 01' 27" East, continuing along said East right-of-way line of Holliday Creek, a distance of 25. 18 feet to a point; THENCE North 19° 01' 03" West, continuing along said East right-of-way line of Holliday Creek, a distance of 24.43 feet to a point, said point being in the North line of said Block 1; 2 THENCE South 89° 12' 45" East, leaving said East right-of-way line of Holliday Creek and along the North line of said Block 1, a distance of 700. 15 feet to a point, said point being the Northeast corner of this; THENCE South 00° 43' 34" West, along East line of said Block 1, a distance of 459.00 feet to the Southeast corner of this; THENCE North 89° 29' 11" West, along said South line of Block 1, a distance of 663.75 feet to a point, said point being the place of beginning and containing 7.27 acres of land, more or less. Grantee shall be liable for taxes on the property hereinabove described beginning the 15th day of September, 1994. TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging, unto the said Grantee, his heirs and assigns forever. The City of Wichita Falls does hereby bind itself and its successors and assigns to Warrant and Forever Defend all and singular the said premises unto the said Steve A. Nielsen, his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under the aforesaid Grantors, but not otherwise.
