AN ORDINANCE CLOSING, VACATING, AND ABANDONING A
TWENTY-FIVE FEET WIDE, EAST-WEST ALLEY, LYING
BETWEEN LOTS 3 & 4, BLOCK 1, KEMP & JACKSON
SUBDIVISION, WICHITA FALLS, TEXAS, AND RETAINING
A UTILITY EASEMENT
WHEREAS, the Planning & Zoning Commission has recommended
the closure of a twenty-five ( 25) feet wide, east-west alley,
lying between Lots 3 & 4, Block 1, Kemp & Jackson Subdivision,
subject to the retention of a utility easement to be left
unfenced; and,
WHEREAS, the City Council of the City of Wichita Falls,
Texas, deems it advisable and in the public interest to close
the alley hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The twenty-five ( 25) feet wide, east-west
alley, lying between Lots 3 & 4, Block 1, Kemp & Jackson
Subdivision, Wichita Falls, Texas, and bounded in the east by
the west right-of-way line of Denver Avenue, and to the west
by the east right-of-way line of a north-south 25 feet wide
alley, is hereby closed, vacated, and abandoned.
SECTION 2. The City of Wichita Falls hereby reserves the
entire area described in Section 1, as a utility easement for
the purpose of laying and maintaining all kind and character
of utility lines including water, gas, electric, telephone,
television cable, power lines, and sanitary and storm sewer.
This utility easement shall not be fenced or obstructed in any
manner.
