Ord 095-86 11/18/1986 ORDINANCE NO. 95-86 AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION OF A TWENTY-FIVE ( 25) FOOT WIDE, NORTH- SOUTH ALLEY IN THE CURTIS & JAMES SUBDIVISION OF BLOCK 254, ORIGINAL TOWNSITE, WICHITA FALLS, TEXAS, AND RETAINING A UTILITY EASEMENT WHEREAS, the Planning & Zoning Commission has recommended the closure of the westerly nine (9) feet of a twenty-five ( 25) foot wide north-south alley, subject to the retention of a utility easement; and, WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it advisable and in the public interest to close the portion of the alley hereafter described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The westerly nine (9) foot wide portion of a twenty-five ( 25) foot wide north-south alley abutting and east of the easterly lot line of Lot 6-A, Curtis & James Subdi- vision of Block 254, Original Townsite, Wichita Falls, Texas; and bounded on the north by the southerly right-of-way line of 11th Street, and on the south by the northerly right-of-way line of 12th Street; is hereby closed, vacated, and abandoned. SECTION 2. The entire area of the closed alley described in Section 1 is hereby retained as a utility easement, for the purposes of laying and maintaining all kinds and character of utility lines, including water, gas, electric, telephone, T.V. cable, power lines, and sanitary and storm sewers. Said ease- ment shall not be fenced so as to obstruct vehicular traffic. SECTION 3 . This ordinance shall become effective upon the installation of a drainage pipe as required by the Director of Public Works, within six (6) months from the passage of this ordinance.
