ORDINANCE NO. 96-86
AN ORDINANCE CLOSING, VACATING, AND ABANDONING A
PORTION OF A UTILITY EASEMENT LYING ON THE SOUTH
BOUNDARY OF LOT 4, BLOCK 7, MCKENZIE SUBDIVISION,
WICHITA FALLS, TEXAS
WHEREAS, the utility easement along the rear property
line of Lot 4, Block 7, McKenzie Subdivision, Wichita Falls,
Texas, is encroached upon by various structures and a swimming
pool; and,
WHEREAS, the utility lines located in that easement have
been relocated, and the portion of the easement hereafter
described is no longer required; and,
WHEREAS, the City Council of the City of Wichita Falls,
Texas deems it advisable and in the public interest to close
the portion of the easement hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The portion of a utility easement across the south side
of Lot 4, Block 7, McKenzie Subdivision, as recorded in Volume
22, pages 63 & 64, Wichita County plat records, and described
by metes and bounds as follows:
BEGINNING at a point which bears N 00° 44 ' E a distance
of 2.8 feet and N 89° 16 ' W a distance of 10.0 feet from the
Southeast corner of said Lot 4;
THENCE N 89° 16' W parallel to and 2.80 feet North of the
South line of said Lot 4, a distance of 113. 52 feet to a point
in the West line of said Lot 4;
THENCE N 34° 26' E with said West line a distance of 8.70
feet;
THENCE S 89° 16 ' E parallel to and 10.0 feet North of the
South line of said Lot 4 a distance of 108.72 feet;
THENCE S 00° 44 ' W parallel to and 10.0 feet West of the
East line of said Lot 4 a distance of 7.20 feet to the Place
of Beginning;
is hereby closed, vacated and abandoned.
