Ord 100-86 12/16/1986 ORDINANCE NO. 100-86
WHEREAS, the City Council of the City of Wichita Falls,
Texas, (the "City" ) in its efforts to promote the development
and redevelopment of a certain contiguous geographic area
within its jurisdiction established Reinvestment Zone Number 1
on March 18, 1986 (Ord. No. 22-86) ; and,
•
WHEREAS, the boundaries of such reinvestment zone were
described by the description attached as Exhibit B and
depicted in the attached map as Map 2; and,
WHEREAS, the two descriptions did not describe the same
area in that the southernmost area surrounding the hospitals
and depicted on the map was omitted from the field notes; and,
WHEREAS, the City Council of the City of Wichita Falls,
Texas, desires to include this area in Reinvestment Zone
Number 1; and,
WHEREAS, a hearing before the City Council was held at
5: 30 p.m. on December 16, 1986, such date being at least seven
(7) days after the date of publication of the notice of such
public hearing; and,
WHEREAS, the City published notice of such hearing as
required by Section 4 of Article 1066e; and,
WHEREAS, the City at such hearing invited any interested
person, or his agent, to appear and contend for or against the
expansion of the boundaries of Reinvestment Zone Number 1;
and,
WHEREAS, all owners of property located within the
expanded boundaries of the reinvestment zone and all other
taxing units and other interested persons were given the
opportunity at such public hearing to state their opinion.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City hereby amends the boundaries of
Reinvestment Zone Number 1, Wichita Falls, Texas to include
the approximately 56 acres surrounding the hospital district
as depicted in the map hereto attached, such description
hereto attached.
SECTION 2. The City Council, after conducting a public
hearing and having heard such evidence and testimony presented
at such hearing, has made the following findings and determi-
ation:
A. Not more than 10 percent of the property in the
amended zone, excluding that dedicated to public use, is used
for residential purposes, which is defined in Article 1066e,
as any property occupied by a house which has less than five
living units.
B. The total appraised value of all taxable real property
in the amended zone according to the 1986 appraisal rolls of
the city, together with the total appraised value of taxable
real property in all other existing reinvestment zones within
the city, does not exceed 15 percent of the current total
appraised value of taxable real property in the city.
C. Improvements in the amended reinvestment zone will
enhance significantly the value of all taxable real property
in the zone and will be of general benefit to the city.
SECTION 3. If any section, paragraph, clause or provi-
sion of this Ordinance shall for any reason be held to be
invalid or unenforceable, the invalidity or unenforceability
of such section, paragraph, clause or provision shall not
affect any of the remaining provisions of this Ordinance.
SECTION 4. It is hereby found, determined and declared
that a sufficient written notice of the date, hour, place and
subject of the meeting of the City Council at which this
Ordinance was adopted was posted at a place convenient and
readily accessible at all times to the general public at the
City Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-17, Vernon' s Texas Civil Statutes, as amended, and this
meeting has been open to the public as required by law at all
times during which this Ordinance and the subject matter
hereof has been discussed, considered and formally acted upon.
The City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
SECTION 5. The contents of the notice of public hearing,
which hearing was held before the City Council on December 16,
1986, and the publication of said notice, is hereby ratified,
approved and confirmed.
SECTION 6. It is hereby officially found and determined
that final designation of Reinvestment Zone Number 1 in 1986
is an urgent public necessity, that correction of errors in
the field notes was pursued as such error was discovered, that
the sixty ( 60) day statutory notice requirement precluded
presentation of this amendment prior to this meeting, that
ample notice has been furnished regarding this amendment, and
that these facts present a case of emergency, which requires
the holding of the meeting at which this Ordinance amending
Reinvestment Zone Number 1 is passed and further requires that
this Ordinance be passed finally and shall become effective
immediately upon its passage.
