ORDINANCE WAIVING PART OF SECTION 5-47 OF
ORDINANCE NO. 63-85 TO ALLOW THE KEEPING OF
LIVESTOCK AT 1115 ROWLAND ROAD, LESS THAN 200
FEET FROM A RESIDENCE LOCATED ON ANOTHER ' S
PROPERTY.
WHEREAS, Section 5-47 of Ordinance No . 63-85 prohibits
the keeping of livestock , in an enclosure, any part of which
is nearer than 200 feet from any residence located on
another ' s property; and ,
WHEREAS, Jerry Ross, wishes to keep livestock , two
horses and a calf, on his property located at 1115 Rowland
Road which encompasses 1 .9 acres; and ,
WHEREAS, there are several houses, including a church ,
closer than 200 feet to the fenceline, but all property
owners have expressed no objection to the keeping of
livestock on the property; and ,
WHEREAS, the City Council finds that the circumstances
involved in this matter are exceptional , and that a waiver
should be granted .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT;
The setback requirement of 200 feet for the keeping of
livestock , contained in Section 5-47 of Ordinance No . 63-85,
is hereby waived to allow livestock to be kept at 1115
Rowland Road since none of the neighbors whose 'residence is
closer than 200 feet from the fenceline object
