AN ORDINANCE AMENDING THE CITY' S ELECTRICAL CODE
BY REQUIRING INSURANCE, DELETING THE REQUIREMENT
FOR BONDS, AND PROVIDING FOR ELECTRICAL LICENSING
RECIPROCITY UNDER CERTAIN CONDITIONS
WHEREAS, the Board of Electrical Examiners has determined
that electrical contractors licensed in the city should be
required to have in force liability insurance in lieu of the
present compliance bond; and,
WHEREAS, the Board of Electrical Examiners has proposed
that the Code of Ordinances be amended to allow electrical
licensing reciprocity with other cities pursuant to agreements
between cities and subject to Board license equivalency
review; and,
WHEREAS, the City Council determines these amendments to
be in the best interest of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 14-20 of the Electrical Code of the
City of Wichita Falls is hereby amended by adding paragraph
(D) to read as follows:
" (D) Insurance required: Any person, company, firm,
partnership, or corporation engaged in the electrical con-
tracting business in the corporate limits of the City of
Wichita Falls, shall obtain and have in full force and effect
a policy of liability insurance, insuring against claims or
actions for personal injuries or property damage occurring or
claiming to have occurred upon or growing out of engaging in
the electrical contracting business with limits as follows:
Injuries to or death of one person, One Hundred Thousand
Dollars ( $100,000.00) ; injuries to or death of more than one
person, Three Hundred Thousand Dollars ( $300,000. 00) ; and
property damage pertaining to any one accident or occurrence,
Twenty-five Thousand Dollars ( $25,000. 00) . A current certif-
icate of insurance meeting or exceeding these limits must be
on file in the chief electrical inspectors office prior to the
issuance of any permit. The insurance coverage shall include
a provision that in the event such coverage is canceled or
reduced, the insurance carrier shall notify the chief
electrical inspector at least ten ( 10) days prior to such
cancellation or reduction in coverage. "
SECTION 2. Section 14-21(C) of the Electrical Code of
the City of Wichita Falls is hereby amended to read as
follows:
" (C) License fees, issuance, expiration date: A
successful applicant shall pay to the secretary the sum of two
hundred dollars ( $200.00) as the first year' s license fee.
The two hundred dollars ( $200.00) must be paid within thirty
( 30) days after the grading of the examination paper and prior
to beginning work; otherwise, the examination shall be null
and void. In case of failure to pass this examination, an
applicant must wait ninety ( 90) days before being allowed to
take another examination. The waiting periods commence on the
date the examination paper is graded. The fee of thirty
dollars ($30.00) shall be required for each examination.
When a master electrician has not obtained permits for
electrical work within a one year period in the City of
Wichita Falls, it will be his responsibility to prove that he
is actively engaged in the electrical business as a master
electrician in order to obtain a license renewal. If such
evidence of activity is found by the Board of Electrical
Examiners to be lacking, they shall require the applicant to
take the applicable examination to show that said applicant is
qualified.
Qualified applicants who comply with the above provisions
shall be issued a license signed by the secretary and chairman
of the Board of Electrical Examiners. The license shall be
valid for the remainder of the calendar year.
All present and future license shall expire each December
31 annually."
SECTION 3 . Section 14-26 of the Electrical Code of the
City of Wichita Falls is hereby amended to add the following:
"Sec. 14-26 Reciprocal Licenses. A Master Electrician or
Journeyman Electrician currently licensed in another city may
apply for and receive an equivalent license in the City of
Wichita Falls without taking the required examination under
the following conditions:
1. He shall submit evidence satisfactory to a majority of
the Board that his current license was issued by a city
operating under the National Electrical Code as currently
adopted by the City of Wichita Falls, or a later edition of
said code.
2. He shall submit evidence satisfactory to a majority of
the Board that his current license was issued under conditions
not less restrictive than required by the City of Wichita
Falls Electrical Code for issuance of such license.
3. He shall submit evidence satisfactory to a majority of
the Board that an electrician holding a license issued by the
City of Wichita Falls would be permitted to apply for and
receive a similar license in such other city under reciprocal
conditions pursuant to an agreement between the licensing
bodies of the two cities.
4. He shall pay all license fees and comply with all
other requirements of this code. "
