ORDINANCE NO. 18-87
AN ORDINANCE CLOSING, VACATING, AND ABANDONING THE
PORTION OF 26TH STREET LYING BETWEEN JASPER STREET
AND OLD JACKSBORO HIGHWAY, WICHITA FALLS, TEXAS
WHEREAS, the Planning & Zoning Commission has recommended
the closure of the portion of 26th Street, between Jasper Street
and Old Jacksboro Highway, subject to the retention of certain
easements, and,
WHEREAS, the City Council of the City of Wichita Falls,
Texas deems it advisable and in the public interest to close the
street hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The portion of 26th Street lying east of the
east right-of-way line of Jasper Street and west of the westerly
right-of-way line of Old Jacksboro Highway, Wichita Falls, Texas,
is hereby closed, vacated, and abandoned.
SECTION 2. The City of Wichita Falls hereby reserves a
utility easement for the purpose of laying and maintaining all
kind and character of utility lines, including water, gas, elec-
tric, telephone, T.V. cable, power lines, and sanitary and storm
sewers in the portion of the closed street right-of-way of 26th
Street described below:
Beginning at the intersection of the east right-of-way
of 26th Street and the west right-of-way of Old Jacks-
boro Highway, and extending to the west for a distance
of two hundred and fifty ( 250) feet measured along the
centerline of 26th Street.
SECTION 3 . The City of Wichita Falls hereby also retains
an access easement over the entire area of Section 1, until such
time as Holliday Creek Drainage Project is completed, at which
time the Director of Public Works is authorized to re ease such
access easement.
