Ord 023-87 4/7/1987 . ORDINANCE NO. A.9-17 ORDINANCE WAIVING SECTION 25-69 OF THE CODE OF ORDINANCES TO ALLOW THE OPERATION OF A TRANSIENT SHOW AT THE NOTRE DAME HIGH SCHOOL ELEVENTH ANNUAL SPRING FESTIVAL ON MAY 1, 2 AND 3 , 1987 , AND AUTHORIZING TEMPORARY ON-PREMISE SALE OF WINE AND BEER PURSUANT TO SECTION 5420 (5) OF THE ZONING ORDINANCE. WHEREAS, the Notre Dame Schools are planning their eleventh Annual Spring Festival on May 1, 2 , and 3 , 1987 , to be held on the Notre Dame High School parking lot and grounds; and, WHEREAS, Notre Dame Schools have requested a waiver of Section 25-69 of the Code of Ordinances, which prohibits any transient show from locating within 300 feet of any private residence, church or school; and, WHEREAS, such Schools have also requested permission to sell wine and beer at such festival, and Section 5420 (5) of the Zoning Ordinance allows temporary alcoholic beverage sales subject to City Council approval; and, WHEREAS, the City Council finds that the circumstances involved in this situation are exceptional, and that such waiver of Section 25-69 should be granted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The requirements of Section 25-69 of the Code of Ordinances of the City of Wichita Falls are hereby waived to allow the issuance of a license to Notre Dame Schools, or its concessionaire, to allow location of a transient show on the Notre Dame High School parking lot and grounds on May 1, 2 , and 3 , 1987 . On-premise sale of wine and beer is hereby authorized on May 1, 2 and 3, 1987 for such eleventh Annual Spring Festival sponsored by the Notre Dame Schools to be held on the Notre Dame High School parking lot and grounds, pursuant to Section 5420 (5) of the Zoning Ordinance. The fact that this event will be held in less than thirty (30) days after passage of this ordinance creates an emergency; therefore, this ordinance is declared to be an emergency measure and shall become effective immediately upon its passage.
