ORDINANCE ESTABLISHING A
COMMISSION ON AGING
WHEREAS, on August 5, 1986 the City Council of the City of
Wichita Falls passed a resolution creating a Task Force on Aging
to study problems of the aging, and to begin to form a Commission
on Aging; and,
WHEREAS, the Task Force on Aging completed its study and
presented a report to the City Council at the City Council
meeting on March 17 , 1987 recommending that the City Council
establish a Commission on Aging; and,
WHEREAS, the Task Force on Aging determined that the
establishment of a Commission on Aging with the goal of greater
development of community based service for the aging would
represent a progressive step towards addressing the needs,
problems and positive options for the aging of the Wichita Falls
community; and,
WHEREAS, the Task Force on Aging determined the purpose of a
Commission on Aging would be to:
Monitor and maximize the availability and use of present
services to the aging
Contest the erosion of service levels
Encourage the development of existing community resources
and solicit further such resources to assist in meeting the needs
of the aging
Focus attention on practical solutions to maintain and
increase funding for essential services to the aging
Devote time and attention to the long perspective and
investigate preventative models such as alternative programs to
assist the aging to remain in their homes and fitness programs
for the aging
Support present services by encouraging volunteerism
Examine specific needs and requests related to the aging and
make recommendations to the City Council
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Section 1. Creation.
There is hereby established a Commission on Aging, which
shall address the needs, problems and positive options for the
aging of the Wichita Falls community. The commission shall
consist of fifteen members.
Section 2. Qualifications of Members.
Members of the commission shall be appointed by the City
Council and shall serve without compensation. Members shall be
residents of the City of Wichita Falls and shall be committed to
the goals of the commission. Members, while serving, shall not
hold elective city office.
Section 3 . Representation.
Commission members shall include a broad representation of
our community, such as varied educational and ethnic backgrounds,
sexes, ages. Members shall be chosen from a geographic spread of
the community.
Section 4. Terms of Office.
Initially, seven (7) members of the commission shall be
appointed for a term of one ( 1) year expiring May 31, 1988 and
the remainder shall be appointed for a term of two ( 2) years
expiring May 31, 1989 in order to maintain continuity of the
commission. Thereafter, each member of the commission shall be
appointed for a term of two ( 2) years expiring May 31 or until a
successor is named. Appointments to fill any vacancy on the
commission shall be made by the City Council, and that member
shall serve for the remainder of the unexpired term of office.
When any member of the commission fails to attend three ( 3)
consecutive meetings without due cause, the chairperson shall
certify the same to the City Council. Such member shall then be
deemed to have been removed and a vacancy created. No member
shall serve on the commission more than three ( 3 ) consecutive
terms.
Section 5. Organization of the Commission.
The members of the commission shall elect a chairperson for
a one ( 1) year term and such other officers as may be deemed
necessary or desirable, who shall serve at the will of the
commission. The chairperson shall have a vote equal to that of
the other members of the commission. Nine ( 9) members of the
commission shall constitute a quorum. The commission shall hold
monthly meetings at least nine ( 9) months during a calendar year.
The chairperson may call meetings of the commission, and meetings
may be called by written notice postmarked ten ( 10) days in
advance and signed by seven (7) members, and the commission at
any meeting may fix and call a meeting on a future date. Minutes
shall be kept of all meetings of the commission and shall be
regularly sent to the City Council. All meetings shall be
public.

Section 6. Duties and Powers of the Commission.
The commission shall have the following duties, functions,
powers and responsibilities:
(a) To serve in an advisory capacity to the City
Council in respect to all matters pertaining to the general
welfare and advancement of the aging, including but not limited
to legal and civil rights, health care, appropriate
accommodation, maintenance for independent living, economic
status, community access, employment, political opportunity,
quality of life and preventative support systems.
(b) To conduct public outreach efforts, including but
not limited to surveys, public hearings, seminars and
informational programs, in order to gain information on the needs
of the aging and to make findings and recommendations to the
Mayor and the City Council.
(c) To appoint at its discretion subcommittees to
concern themselves with specific problems relating to the aging
and to formulate and recommend plans and programs. Subcommittees
shall be chaired by commission members.
(d) To perform such other duties as may from time to
time be assigned to it by resolution of the City Council.
Section 7 . Limitation of Powers.
The powers and jurisdiction of the commission shall be
purely advisory, voluntary and persuasive. The commission shall
not have any power or authority to subpoena or compel the
attendance of witnesses. The commission shall have no power to
appoint city officers or employees or to make policy decisions,
or to manage, control or administer institutions relating to the
aging in Wichita Falls.
Section 8 . Severability.
If any section, subsection, sentence, clause or provision of
this ordinance is held invalid, the remainder of this ordinance
shall not be affected by such invalidity.
