ORDINANCE AMENDING SECTION 2 AND SECTION 14 ,
APPENDIX A, WICHITA FALLS CODE OF ORDINANCES
(COMPREHENSIVE SUBDIVISION ORDINANCE NO. 2118)
ON REQUIREMENTS FOR PLATTING OR REPLATTING.
WHEREAS, the Planning and Zoning Commission has recommended
that platting or replatting not be required for remodeling
of existing structures without adding to the floor area, or
for addition of floor area or construction of accessory struc-
tures, which are less than 50% of the floor area of the
existing structure; and,
WHEREAS, the City Council of the City of Wichita Falls
deems it advisable and in the public interest to amend the
platting and replatting requirements hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 2 , Appendix A, Wichita Falls Code
of Ordinances (Comprehensive Subdivision Ordinance No. 2118)
is hereby amended to add the following subsection:
" (d) The requirement to plat stated in Subsection (c)
shall not apply when the owner of a tract of land proposes to:
(i) Remodel an existing structure without adding
to the floor area.
(ii) Add additional floor area or construct
accessory structures to an existing single-family or duplex
residential use, when such addition or construction is less
than 50% of the existing floor area and does not encroach over
a utility line or easement. "
SECTION 2 . Subsection (B) of Section 14 , Appendix A,
Wichita Falls Code of Ordinances (Comprehensive Subdivision
Ordinance No. 2118) is hereby amended to read as follows:
" (B) No building, repair, plumbing or electrical permit
shall be issued by the City for any structure on a lot in a
subdivision in which a final plat has not been approved or
on a lot in a subdivision in which the standards contained
herein or referred to herein have not been complied with in
full, except in those situations described in Subsection (d)
of Section 2 of this ordinance. "
