RESOLUTION TO ACCEPT KEMP BLVD. WATER LINE
RELOCATION PROJECT AS COMPLETE AND AUTHORIZE
FINAL PAYMENT TO CONTRACTOR
WHEREAS, the City of Wichita Falls has a contract with
Starks Construction Company for the Kemp Blvd. Water Line
Relocation Project;
WHEREAS, the original amount of the contract was $170,428,
and this amount was increased by two approved change orders to a
final contract price of $171,550;
WHEREAS, the actual amount of work completed for the
contract was $171,835, and the Contractor had been paid progress
payments of $167,539.12, leaving an unpaid amount of $4,295.88;
WHEREAS, the Contractor did not complete the project by the
contract agreed completion date, and liquidated damages for
seventeen days are to be applied in the amount of $4,080, leaving
a final payment to the Contractor or $215.88; and,
WHEREAS, the Staff has inspected the project and has found
it to be installed by the plans and specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The Kemp Blvd. Water Line Relocation Project is hereby
accepted as complete, and the City Manager is authorized to make
a final payment to the Contractor in the amount of $215.88.
