RESOLUTION AUTHORIZING THE SALE OF PORTIONS OF A
CLOSED IRRIGATION DITCH ON 26TH STREET TO THE
ADJACENT PROPERTY OWNERS AND AUTHORIZING THE MAYOR
TO EXECUTE THE QUIT CLAIM DEEDS; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS DISCUSSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls is the owner of the closed
irrigation canal in the 1400 block of 26th Street; and,
WHEREAS, said canal is no longer used by the City, and there are
no plans for future usage; and,
WHEREAS, in accordance with Chapter 272 of the Local Government
Code, the City may divide this strip of land equally among the adjacent
property owners and offer it for sale at the fair market value.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS:
SECTION 1. The Mayor of the City of Wichita Falls be and is
hereby authorized to execute quit claim deeds on behalf of the City of
Wichita Falls to the following parties for the consideration stated:
Tract I A 2,484 square foot tract, more or less, out of Block
8, John A. Scott Survey No. 10 at the rear of 1411 26th Street,
Wichita Falls.
To be conveyed to Joe P. Splawn for the consideration of $70.00
Tract II A 1,824 square foot tract, more or less, out of Block
8, John A. Scott Survey No. 10 at the rear of 1409 26th Street,
Wichita Falls.
To be conveyed to Kenneth Mahler and wife, Almeda Mahler for the
consideration of $51.00.
Tract III A 2,875 square foot tract, more or less, out of Block
8, John A. Scott Survey No. 10 at the rear of 1407 26th Street,
Wichita Falls.
To be conveyed to Metropolitan Community Church of Wichita Falls
for the consideration of $80.00.
Tract IV A 1,964 square foot tract, more or less, out of Block
8, John A. Scott Survey, No. 10 at the rear of 1209 26th Street,
Wichita Falls.
To be conveyed to Jerry D. Alexander and wife, Linda Alexander for
the consideration of $55.00.
SECTION 2. It is hereby officially found and determined that the
meeting at which this resolution was passed was open to the public as
required by law.
