A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, DETERMINING NECESSITY FOR
ACQUISITION OF EASEMENTS FOR THE 30TH AND TRAVIS
DRAINAGE PROJECT AND AUTHORIZING PURCHASE OR
CONDEMNATION; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS DISCUSSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, plans have been prepared to construct a concrete -lined
drainage ditch in the 1200 block of 30th Street in order to improve the
drainage conditions in the immediate neighborhood; and
WHEREAS, it has been determined that three drainage easements and
the fee taking of an uneconomic remainder, as well as eight temporary
construction easements must be acquired prior to the construction of
this project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS:
SECTION 1. It is necessary that the City of Wichita Falls acquire
the hereinafter described property located in Wichita Falls, Wichita
County, Texas for the 30th and Travis Drainage Project.
SECTION 2. The legal descriptions of the drainage easements to be
acquired are as follows:
Parcel # 1 A 42 square foot tract out of Lot 12, Block 1,
Hillcrest Addition.
Parcel # 2 A 1,263 square foot tract out of Lot 11, Block 1,
Hillcrest Addition.
Parcel # 3 A 1,291 square foot tract out of Lot 10, Block 1,
Hillcrest Addition.
The legal description of a uneconomic remainder to be acquired in
fee title is as follows:
Parcel # 4 A 494 square foot tract out of Lot 11, Block 1,
Hillcrest Addition.

Parcel # 1 TCE A 958 square foot tract out of Lot 12, Block 1,
Hillcrest Addition.
Parcel # 2 TCE A 2,831 square foot tract out of Lot 11, Block 1,

Parcel # 5 TCE A 250 square foot tract out of Lot 13, Block 1,
Hillcrest Addition.
Parcel # 6 TCE A 129 square foot tract out of Lot 14, Block 1,
Hillcrest Addition.
Parcel # 7 TCE A 741 square foot tract out of Lot 23, Block 1,
Hillcrest Addition.
Parcel # 8 TCE A 1,263 square foot tract out of Lot 20, Block 1,
Hillcrest Addition.

SECTION 3. The amount of just compensation for the property to be
acquired is as follows:

The amounts of just compensation are also the fair market value
determined by Henderson Appraisal and Consultants, who were employed by
the City to appraise the tracts.
SECTION 4. In the event the Property Administrator is unable to
purchase the parcels for the appraised value, the City Manager is
authorized to increase the offer when, in his judgment, it appears to
be in the best interest of the City to do so to save the cost of
condemnation. If both parties are unable to agree upon a value for the
property, the City Attorney is hereby authorized to institute
condemnation proceedings to obtain such property in the name of the
City of Wichita Falls for the 30th and Travis Drainage Project.
SECTION S. It is officially found and determined that the meeting
at which this resolution was passed was open to the public as required
by law.
