Res 009-95 1/17/1995RESOLUTION NO. CA - (-05- RESOLUTION TO ACCEPT RIVER ROAD WASTEWATER TREATMENT PLANT ADDITIONS AND MODIFICATIONS PROJECT AS COMPLETE AND AUTHORIZE FINAL PAYMENT TO CONTRACTOR WHEREAS, the City has a contract with Craig, Sheffield and Austin, Inc. for the construction of certain modifications and additions at the River Road Wastewater Treatment Plant; WHEREAS, the original amount of the contract of $19,572,000 was changed by approved change orders during the progress of the work to an adjusted contract price of $19,523,327.21; WHEREAS, the actual amount of work accomplished was $19,520,327.21, and the City previously has paid the contractor an amount of $19,510,327.21, leaving an amount due to the contractor of $10,000.00; WHEREAS, the Contractor owes $2,642.09 in back taxes, penalty and interest included, and this amount will be withheld for payment to the Wichita County Tax Assessor unless the Contractor will have paid the taxes in full, in which case the full $10,000 payment will be made to the Contractor; and, WHEREAS, the project has been certified by the design engineer to be complete and to have been constructed in accordance with the plans and specifications, and the staff has recommended that Council accept the project as complete and authorize a final payment to the contractor. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The River Road Wastewater Treatment Plant Modifications and Additions Project is hereby accepted as complete, and the City Manager is authorized to make a final payment of $10,000.00 to the contractor, withholding $2,642.09 as necessary to make payment of taxes, interest and penalty to the Wichita County Tax Assessor.
