A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE FILING OF A TEXAS NATURAL RESOURCE CONSERVATION COMMISSION GRANT TO LOCAL GOVERNMENTS FOR SOLID WASTE ENFORCEMENT ASSISTANCE AND AUTHORIZING THE CITY MANAGER TO ACT AS THE CITY'S CHIEF EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE CITY'S PARTICIPATION IN THE SOLID WASTE ENFORCEMENT ASSISTANCE PROGRAM; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls has identified need related to solid waste enforcement enhancement and expansion; and, WHEREAS, the provision of solid waste enforcement program enhancement and expansion will assist in meeting such need; and, WHEREAS, it is necessary and in the best public interest, health and welfare that the City of Wichita Falls, Texas, apply for funding under the 1993 Texas Natural Resource Conservation Commission's Grant to Local Governments for Solid Waste Enforcement Assistance Program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City of Wichita Falls, Texas, submit an application for funding under the Texas Natural Resource Conservation Commission's Municipal Solid Waste Enforcement Support Program. SECTION 2. The City Council endorses the activities as set forth in said application. SECTION 3. The City of Wichita Falls, Texas, will comply with the provisions of the fiscal reimbursement and reporting requirements of the Texas Natural Resource Conservation Commission and the State of Texas. SECTION 4. The funds will be used only for the purposes for which they are provided. Page 2 of 3 Pages Agenda Item No. SECTION 5. The proposed project is in compliance with and supports any adopted regional or local solid waste management plan applicable to the geographical area covered by the project. SECTION 6. The City Council of the City of Wichita Falls, Texas, directs and designates the City Manager as the City's Chief Executive Officer and Authorized Representative to act in all matters in connection with this application and the City's participation in the Texas Natural Resource Conservation Commission's Local Government Solid Waste Grant assistance Program. SECTION 7. It is officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 6th day of June, 1995.
