A RESOLUTION REVERSING THE DISAPPROVAL OF THE
REINSTATEMENT OF CONDITIONAL USE PERMIT NO. C 96-14, FOR
RETAIL SALES IN A LIMITED COMMERCIAL ZONE AT 1526 KELL
BLVD., WICHITA FALLS, TEXAS, AND GRANTING THE PERMIT,
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the Planning & Zoning Commission has disapproved a request to reinstate a revoked
Conditional Use Permit at 1526 Kell Blvd.; and
WHEREAS, the applicant has appealed that decision; and,
WHEREAS, the City Council desires that the applicant be given additional time to come into
compliance with the conditions contained within Conditional Use Permit C 96-14.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. The disapproval by the Planning & Zoning Commission of the reinstatement of
Conditional Use Permit No. C 96-14 is hereby reversed and the permit is reinstated.
SECTION 2. The owner and subsequent owner of Advanced Golf Carts shall be given 30 days to
comply with the terms of Conditional Use Permit C 96-14. Should the owner fail to comply with these
conditions within this period, the Planning & Zoning Commission is directed to revoke this permit
without further delay.
SECTION 3. It is hereby officially found and determined that the meeting at which this resolution
was passed was open to the public as required by law.
