RESOLUTION TO ACCEPT PROJECT TO ABANDON 48-INCH
DRAIN VALVES AT LAKE DIVERSION AND AUTHORIZE
CITY MANAGER TO MAKE FINAL PAYMENT TO
CONTRACTOR
WHEREAS, the City of Wichita Falls and Wichita County Water
Improvement District #2 have a contract with Earth Builders, Inc.
for the abandonment of two 48-inch drain valves at Lake Diversion;
WHEREAS, the final contract amount was $47, 635, and the City
and District have previously paid the contractor an amount of
46 , 682 . 30, leaving an amount due of $952 . 70 to be paid jointly by
the City ($523 . 98) and District ($428 . 72) ; and,
WHEREAS, the Staff has recommended the project be accepted as
complete .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The project to abandon two 48-inch drain valves at Lake
Diversion is hereby accepted as complete, and the City Manager is
authorized to make a final payment to the contractor in the amount
of $952 . 70, with a reimbursement from Wichita County Water
Improvement District #2 in the amount of $428 . 72 .
