A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS ABANDONING A UTILITY EASEMENT IN
BLOCK 13 OF BURLINGTON CALLFIELD INDUSTRIAL
DISTRICT AND AUTHORIZING THE MAYOR TO EXECUTE A
QUIT CLAIM DEED FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Preston Products has plans to expand their facility at
3201 Lawrence Road; and,
WHEREAS, they have submitted a request to abandon the five foot
utility easement on the property in order to accommodate this
expansion.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. In consideration of the receipt of $2, 750 . 00 and other
valuable considerations, the Mayor is hereby authorized to execute a
quit clam deed to Preston Products conveying a five foot wide utility
easement, which is further described on the attached quit claim deed,
the same made a part hereof .
SECTION 2 . It is hereby officially found and determined that the
meeting at which this resolution was passed was open to the public as
required by law.
PASSED AND APPROVED this the 2nd day of July, 1996 .

COUNTY OF WICHITA §
THAT the City of Wichita Falls, Texas, a municipal corporation,
hereinafter called Grantor, acting by and through its duly authorized
Mayor, for and in consideration of the sum of Two Thousand Seven
Hundred Fifty and no/100 ($2, 750 . 00) Dollars and other good and
valuable consideration in hand paid by Preston Products, P.O. Box 818,
Burkburnett, Texas 76354, hereinafter called Grantee, the receipt of
which is herein acknowledged, has granted, sold, conveyed, released,
and forever quit claims unto the said Grantee, all its right, title,
and interest in and to the following described real property situated
in Wichita County, Texas, to-wit :
FIELD NOTES OF A 5 . 0 FOOT WIDE UTILITY EASEMENT ACROSS LOT
1-B, BLOCK 13 , BURLINGTON CALLFIELD INDUSTRIAL DISTRICT OF
WICHITA FALLS, TEXAS AS RECORDED IN VOLUME 25, PAGE 243 ,
WICHITA COUNTY PLAT RECORDS, AND DESCRIBED AS FOLLOWS :
BEGINNING at a point in the West line of Lot 1-B, Block 13, Burlington
Callfield Industrial District which bears N 00°35' E a distance of 15 . 0
feet from its Southwest corner;
THENCE N 00°35' E with the West line of said Lot 1-B, a distance of 5 . 0
feet;
THENCE East a distance of 549 . 87 feet to a point in the East line of
said Lot 1-B, which is 20 . 0 feet North of its Southeast corner;
THENCE South with the East line of said Lot 1-B, a distance of 5 . 0
feet;
THENCE West a distance of 549 . 90 feet to the PLACE OF BEGINNING.
TO HAVE AND TO HOLD the above described premises, together with
all and singular the appurtenances thereto, in any way belonging unto
the said Grantee, its successors and assigns .
