RESOLUTION TO APPROVE AMENDMENT TO WATER PURCHASE
CONTRACT BETWEEN THE CITY OF WICHITA FALLS AND ARCHER
COUNTY MUNICIPAL UTILITY DISTRICT #1 TO AUTHORIZE
ADDITIONAL WATER
WHEREAS, the City of Wichita Falls and Archer County
Municipal Utility District #1 entered into a Water Purchase
Contract on August 21, 1973, and there have been ten amendments
to the original contract;
WHEREAS, the current contract as amended authorizes the
District to purchase sufficient water to serve 300 families and
also authorizes a maximum authorized daily purchase rate of at
least 0 . 6 gallons per minute per connection;
WHEREAS, the Corporation envisions that additional
connections will be required in the future as growth continues in
the District certificated area;
WHEREAS, the District desires to eliminate the limit on the
number of connections and to substitute a provision that provides
for a limit on the maximum amount of water consumed;
WHEREAS, the City desires to incorporate language into the
contract amendment for the approval of water meters and the
disposal of the water supplied in a manner consistent with
current Texas Natural Resource Conservation Commission
regulations, and Archer County Municipal District #1 has agreed
with the additional language for this purpose; and,
WHEREAS, the Council has examined a proposed contract
amendment for the purposes stated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The proposed Eleventh Amendment to the Water Purchase
Contract between the City of Wichita Falls and Archer County
Municipal Utility District #1 is hereby approved, and the City
Manager is authorized to execute the amendment for the City.
