RESOLUTION TO ACCEPT THE 1995 MILL AND
OVERLAY PROJECT AND AUTHORIZE FINAL PAYMENT
TO ZACK BURKETT COMPANY
WHEREAS, the City of Wichita Falls entered a unit price
contract with Zack Burkett Co. with the estimated total cost of
151, 785 . 85 of which $59, 305 . 37 has been previously paid to the
contractor, leaving an amount due of $92, 480 .48 ; and,
WHEREAS, after appropriate adjustments of $480 for
liquidated damages, the final balance due is $92 , 000 .48; and
WHEREAS, the City staff has inspected the work and found it
to be acceptable .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The 1995 CDBG Mill and Overlay Project is hereby accepted,
and the City Manager is authorized to make final payment to the
contractor.
