(()( -q rl A RESOLUTION DETERMINING NECESSITY FOR ACQUISITION OF RIGHT -OF -WAY FOR THE CALL FIELD ROAD WIDENING PROJECT, APPROVING THE APPRAISALS, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUESTED BY LAW. WHEREAS, the Texas Department of Transportation is proposing to widen Call Field Road from Kemp to Lawrence Road; and, WHEREAS, prior to the construction, the City of Wichita Falls must acquire certain parcels of right - of -way as well as temporary construction easements, and, WHEREAS, the appraisals have been completed on these tracts, reviewed by the Property Administrator, and are now on file in the Property Management Office. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire fee simple title to the tracts hereinafter described for the Call Field Road widening project. SECTION 2. The legal descriptions of the parcels to be acquired in fee simple title are as follows: Parcel # CF -1 A 0.252 acre tract out of Lot 2, Block 1, Wichita Square Addition. Parcel # CF -2 A 0.020 acre tract out of Lot 4, Block 1, Wichita Square Addition. Parcel # CF -3 A 0.020 acre tract out of Lot 3 -A, Block 1, Wichita Square Addition. Parcel # CF -4 A 0.044 acre tract out of a 0.589 acre tract in the Day Land & Cattle Company Survey, A -619. Parcel # CF -5 A 0.089 acre tract out of Lot 1, Block 1, Tompkins Addition. Parcel # CF -6 A 0.035 acre tract out of 1.529 acres in Block 214 -A, Highland Addition. Parcel # CF -7 A 0.035 acre tract out of Lot 1, Block 214 -A, Highland Addition. Parcel 9CF-8 A 0.185 acre tract out of Lot 1, Block 9 -A, Faith Village, Unit 1. The legal descriptions of the twelve month temporary construction easements to be acquired are as follows: Parcel #CF -2 TCE A 0.034 acre tract out of Lot 4, Block 1, Wichita Square Addition. Parcel #CF -3 TCE A 0.042 acre tract out of Lot 3A, Block 1, Wichita Square. Parcel #CF -4 TCE A 0.034 acre tract out of 0.589 acres in the Day Land & Cattle Company Survey, A -619. The above described tracts are fully described by metes and bounds from field surveys prepared by Corlett, Probst & Boyd, Inc.. SECTION 3, The amount of just compensation for the above described parcels is as follows: #CF -1 $48,874.00 #CF -5 $35,861.00 #CF -2 10,183.00 #CF -6 15,759.00 #CF -3 7,384.00 #CF -7 11,435.00 #CF -4 17,835.00 #CF -8 64,646.00 #CF -2 TCE 3,258.00 #CF -4 TCE 2,518.00 #CF -3 TCE 2,744.00 These amounts are also the fair market value determined by Crossland Appraisal Company, who was employed by the City to appraise these tracts. SECTION 4. In the event the Property Administrator is unable to purchase the parcels for the appraised value, the City Manager is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Attorney is hereby authorized to institute condemnation proceedings to obtain such property in the name of the City of Wichita Falls for the Call Field Road Widening Project. SECTION 5. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law.
