Res 077-97 5/6/1997RESOLUTION NO. RESOLUTION TO APPROVE CONTRACT FOR THE BENEFICIAL USE OF WATER TREATMENT PLANT SLUDGE ON AGRICULTURAL LANDS WHEREAS, the City of Wichita Falls operates two water treatment plants in accordance with the laws of Federal and State governments, treating raw waters from the Lake Arrowhead and Lake Kickapoo reservoirs; WHEREAS, pebble quick lime ( "lime ") is used to remove hardness from the water, and some of the lime is incorporated as calcium carbonate into the sludge residue of the treatment process; WHEREAS, the sludge from the water treatment process can be beneficial when applied to agricultural lands, such application being a safe and effective method of disposal that is authorized and regulated by State and Federal regulatory agencies; WHEREAS, the owners of a 500-acre tract of agricultural land desire to apply the water supply treatment sludge to their land for the beneficial results that will accrue; WHEREAS, it is in the interest of the City and owners to cooperate for the use of the water supply treatment sludge in this manner; and, WHEREAS, the Council has examined a proposed agreement between the owners and the City of Wichita Falls for the purposes stated. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The proposed agreement between the City of Wichita Falls and the property owners (Phillip James Marten, Gary Don Marten, Stephen D. Marten, and Cindy Sue Swanson) to define mutual responsibilities for the beneficial use of water supply treatment sludge on agricultural lands owned by the owners is hereby approved, and the City Manager is authorized to execute the agreement for the City of Wichita Falls.
