A RESOLUTION DETERMINING NECESSITY FOR ACQUISITION OF
PROPERTY FOR THE FIRE STATION RELOCATION PROJECT,
APPROVING THE APPRAISALS, SETTING JUST COMPENSATION, AND
AUTHORIZING PURCHASE OR CONDEMNATION. FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls is proposing to consolidate the operations of some of the
present fire stations in order to more efficiently serve the citizens; and,
WHEREAS, prior to the construction of three new fire stations, certain tracts of land must be
acquired; and,
WHEREAS, the appraisals have been completed on these tracts, reviewed by the Property
Administrator, and are now on file in the Property Management Office.
NOW, THEREFORE.. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls acquire fee simple title to the tracts
hereinafter described for the Fire Station Relocation Project.
SECTION 2. The legal descriptions of the parcels to be acquired in fee simple title are as follows:
Parcel # ST 3 -4
A 1.845 acre tract out of a 191.7 acres in Block 6, Kemp and Newby Subdivision of Cherokee
County School Land.
Parcel # ST 5
A 1.427 tract out of the E.A. Austin Survey, A -701.
Parcel # ST 7
A 1.50 acre tract out of Lot 1, Block 1, Northview Addition
The above described tracts are fully described by metes and bounds from field surveys prepared by
Corlett, Probst & Boyd, Inc. in February 1997.
SECTION 3. The amount of just compensation for the above described parcels is as follows:
Parcel # ST 3 -4 $68,313.00
Parcel # ST 5 $46,620.00
Parcel # ST 7 $49,005.00
rhese'amounts are also the fair market value determined by Henderson Appraisal and Consultants, who
was employed by the City to appraise these tracts.
SECTION 4. In the event the Property Administrator is unable to purchase the parcels for the
appraised value, the City Manager is authorized to increase the offer when, in his judgment, it appears to
be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to
agree upon a value for the property, the City Attorney is hereby authorized to institute condemnation
proceedings to obtain such property in the name of the City of Wichita Falls for the Fire Station Relocation
Project.
SECTION 5. It is hereby officially found and determined that the meeting at which this resolution
was passed was open to the public as required by law.
