A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, APPROVING NINTH AMENDMENT TO WATER
PURCHASE CONTRACT WITH THE WINDTHORST WATER SUPPLY
CORPORATION; FINDING AND DETERMIlVING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS DISCUSSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls and the Windthorst Water Supply Corporation
entered into a Water Purchase Contract dated August 16, 1979, and there have been eight
amendments to the contract; and,
WHEREAS, the Rural Economic and Community Development Agency requires the
Windthorst Water Supply Corporation to have a contractual obligation for a certain term to
finance improvements by the Windthorst Water Supply Corporation; and,
WHEREAS, the Windthorst Water Supply Corporation has requested a contract
amendment for this purpose; and,
WHEREAS, the Council examined a proposed ninth amendment to the Water Purchase
Contract between the City and the Windthorst Water Supply Corporation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The ninth amendment to the water purchase contract between the City of
Wichita Falls and the Windthorst Water Supply Corporation to provide for a term of forty -two
(42) years from the execution of this amendment is hereby approved, and the City Manager is
authorized to execute the same for the City of Wichita Falls.
SECTION 4. It is officially found and determined that the meeting at which this
resolution was passed was open to the public as required by law.
