RESOLUTION TO AMEND ENGINEERING CONTRACT WITH EMD,
INC.
WHEREAS, the City and the engineering firm of EMD, Inc. entered into an
engineering services contract dated January 7, 1997 whereby EMD would provide
certain specified electrical engineering services;
WHEREAS, one task indicated in the contract to be a part of the base
engineering services and the base engineering fee was originally proposed by the
engineer to be a separate cost item, payable separate from the base fee;
WHEREAS, neither the City staff nor the EMD staff noted the error and each
executed the contract with the error incorporated;
WHEREAS, Staff advises Council that it is right and appropriate for the task to
be paid separately; and,
WHEREAS, Council desires to modify the contract to correct the error.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The task enumerated in Section 1, paragraph D4 of the cited contract related to
the review of shop and working drawings is made a part of Appendix A to the contract,
Compensation for Additional Professional Services, and will be paid separately from the
base fee in the same manner as other enumerated services in Appendix A. The City
Manager is authorized to make payment to the engineer in accordance with this
modification to the contract.
