Res 176-97 12/2/1997RESOLUTION NO.y% A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR THE REDEMPTION OF THE PROPERTY AT 605 FORT WORTH STREET; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, a certain judgment and decree of sale were rendered by the District Court of Wichita County in Cause No. 39,642 -A, the City of Wichita Falls, et al, vs. Freddie and Benetta Johnson, in the matter of delinquent taxes; and, WHEREAS, at the Sheriff's Sale of August 5, 1997, the property at 605 Fort Worth Street, Wichita Falls, Texas, was struck off to the City as trustee for itself and the other taxing entities; and, WHEREAS, on October 24, 1997, Mr. Ernest Franklin, the mortgage holder, paid the taxes and court costs involved in the suit in order to redeem the property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Mayor Kay Yeager is hereby authorized to execute that certain quitclaim deed, attached hereto, which will convey the property described as Lot 3, Block 16, Kemp Addition, a /k/a 605 Fort Worth Street, Wichita Falls, Texas, to Mr. Ernest Franklin, the lien holder of the property. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 2 "d day of DecemhPr 1 Aar ATTEST: City Clergy; OUITCLAIM DEED THE STATE OF TEXAS } COUNTY OF WICHITA } KNOW ALL MEN BY THESE PRESENTS that the CITY OF WICHITA FALLS, acting by and through its Mayor, the WICHITA FALLS INDEPENDENT SCHOOL DISTRICT, acting by and through the President of the Board of Trustees, the WICHITA COUNTY EDUCATION DISTRICT, acting by and through and the COUNTY OF WICHITA, acting by and through the County Judge, as authorized by Section 34.21, Texas Property Tax Code, for and in consideration of the redemption sum of THREE THOUSAND, FIVE HUNDRED AND FORTY -ONE DOLLARS and THREE CENTS ($3,541.03) in hand paid by ERNEST FRANKLIN, Grantee, the receipt of which is hereby acknowledged and confessed, have conveyed and quitclaimed and by these presents do convey and quitclaim unto said Grantee all right, title and interest of the CITY OF WICHITA FALLS, WICHITA FALLS INDEPENDENT SCHOOL DISTRICT, WICHITA COUNTY EDUCATION DISTRICT and WICHITA COUNTY, all taxing units interested in the tax foreclosure judgment against the property herein conveyed, acquired by tax foreclosure sale heretofore held, said property being described as: TRACT 1: Lot 3, Block 16, Kemp Addition, Wichita County, Texas, as more particularly described In a deed recorded in Volume 1585 at Page 273 of the Deed Records of Wichita County, Texas. TO HAVE AND TO HOLD said premises, together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said ERNEST FRANKLIN, his heirs and assigns forever, so that neither the CITY OF WICHITA FALLS, WICHITA FALLS INDEPENDENT SCHOOL DISTRICT, WICHITA COUNTY EDUCATION DISTRICT and COUNTY OF WICHITA, nor any other taxing unit interested in said tax foreclosure judgment, nor any person claiming under it and them, shall at any time hereafter have, claim or demand any right or title to the aforesaid premises or appurtenances, or any part thereof. Taxes for the present year are to be paid by the Grantee.
