RESOLUTION TO ACCEPT PHASE I SEWER IMPROVEMENTS -
MANHOLE REHABILITATION PROJECT AS COMPLETE AND
AUTHORIZE CLOSING THE PROJECT WITHOUT FINAL PAYMENT.
WHEREAS, the City of Wichita Falls entered a contract with Barton Manhole
Rehabilitation Company of Austin, Texas on August 6, 1996 for the Phase I Sewer
Improvements - Manhole Rehabilitation Project at an estimated cost of $210,419;
WHEREAS, the Company satisfactorily completed the work of the project at a
final contract price of $191,270;
WHEREAS, the City has made payments in the amount of $186,488.25, leaving
an amount due to the contractor of $4,781.75;
WHEREAS, the contractor has not provided the documentation required to be
submitted to the Texas Water Development Board so that authorization may be
obtained for final payment;
WHEREAS, several verbal and written communications have occurred between
the City and the owner of Barton Manhole Rehabilitation Company, seeking to obtain
the necessary documentation; and,
WHEREAS, the documentation has not been submitted and the staff has
recommended the project be considered abandoned.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The Phase I Sewer Improvements - Manhole Rehabilitation Project is hereby
considered abandoned by the contractor, and the staff is authorized to close the project
without making final payment. If the contractor subsequently is able to furnish the
documentation required by the Texas Water Development Board, the staff is authorized
to re -open the project and to make final payment without further authorization.
