RESOLUTION TO APPROVE ENCROACHMENT AGREEMENT
ALLOWING CONSTRUCTION OF CONCRETE DRAINAGE SWALE ON
OLD CITY AQUEDUCT
WHEREAS, the City of Wichita Falls owns the old City aqueduct that runs from
Lake Wichita to the Jasper Street Water Treatment Plant;
WHEREAS, an adjacent property owner at 2900 Hamilton Blvd. is constructing a
drainage system to stop the entry of water from the aqueduct onto his private property;
WHEREAS, the property owner has requested permission from the City to
construct a portion of the drainage system, a concrete drainage swale, on the
aqueduct;
WHEREAS, this constitutes an encroachment onto public property and requires
City Council approval; and,
WHEREAS, Council has examined and desires to approve an Encroachment
Agreement for the purposes stated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The proposed Encroachment Agreement to allow the property owner at 2900
Hamilton Blvd. to install a concrete drainage swale on the old City aqueduct is hereby
approved, and the City Manager is authorized to sign the agreement for the City.
