RESOLUTION TO APPROVE REVISED WATER PURCHASE
CONTRACT WITH ARCHER COUNTY MUNICIPAL UTILITY DISTRICT

WHEREAS, the City and Archer County Municipal District #1 ( ACMUD) entered
a Water Purchase Contract on August 21, 1973 and since have mutually agreed to
eleven amendments as well as a Memorandum of Agreement on rate setting principles;
WHEREAS, ACMUD now is applying to the Texas Water Development Board
for a loan to finance system improvements, and the TWDB is requiring an expiration
date on the Water Purchase Contract that runs through the life of the loan;
WHEREAS, ACMUD has asked the City to extend the contract term to the year
2023;
WHEREAS, a new contract has been prepared to incorporate all previous
agreements and to incorporate the ACMUD request for an extended term; and
WHEREAS, the Council has examined and considered a proposed contract for
the purposes stated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The proposed Water Purchase Contract between the City and Archer County
Municipal Utility District #1 is hereby approved, and the City Manager is authorized to
execute the contract on behalf of the City.
