A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AN ENCROACHMENT AGREEMENT WITH THE FIRST UNITED
METHODIST CHURCH FOR A PROPOSED VEHICLE DROP -OFF LANE
AND CANOPY ACROSS A PORTION OF THE TRAVIS STREET RIGHT -
OF -WAY; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Trustees of The First United Methodist Church have requested
an encroachment agreement for a proposed paved vehicle drop -off lane and canopy to
be constructed across a portion of the Travis Street right -of -way; and,
WHEREAS, all utility companies and affected City departments have reviewed
this request and have agreed to the granting of this encroachment agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Manager is hereby authorized to execute an
encroachment agreement with the Trustees of the First United Methodist Church
allowing the construction of a paved vehicle drop -off lane and canopy within the Travis
Street right -of -way described in the encroachment agreement attached hereto as
Exhibit "A" and made a part hereof for all purposes.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.

EXHIBIT "A"
ENCROACHMENT AGREEMENT
STATE OF TEXAS §
COUNTY OF WICHITA § KNOW ALL MEN BY THESE PRESENTS:
THAT the City of Wichita Falls, Texas (hereinafter called "Grantor "), in
consideration of One ($1.00) Dollar and other good and valuable considerations to it in
hand paid, the receipt and sufficiency of which are hereby acknowledged, hereby
grants to the Trustees of The First United Methodist Church of Wichita Falls (hereinafter
collectively called "Grantee "), an encroachment upon, over and across a portion of the
Travis Street right -of -way adjacent to Lots 6 and 7, Block 192, Original Townsite, an
addition to the City of Wichita Falls, Wichita County, Texas, and shown on the attached
property drawing labeled as "Attachment 1" and made a part of this agreement.
This instrument shall be construed as conveying an encroachment to Grantee,
and their respective successors and assigns, for the purpose of constructing a vehicle
drop -off lane and canopy structure upon and across the Grantor's herein described
Travis Street right -of -way.
Should Grantor, or other utility companies occupying the Travis Street right -of-
way by permission of Grantor, need to remove or partially remove Grantee's
improvements on the encroachment herein granted in order to construct or install public
utilities or repair existing utilities or streets, or perform other work for a public purpose
within the herein described street right -of -way, all repairs or reconstruction of Grantee's
improvements resulting from such removal or partial removal shall be at the sole
expense of Grantee.
TO HAVE AND TO HOLD the above - described encroachment unto the said
Grantee, their respective successors or assigns.
