RESOLUTION NO.�
A RESOLUTION GRANTING RIGHT -OF -WAY EASEMENTS TO TXDOT
ON CITY -OWNED PROPERTY FOR THE IH -44 PROJECT AND
AUTHORIZING THE MAYOR TO EXECUTE THE INSTRUMENTS,
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY
LAW.
WHEREAS, TXDOT has the approval to construct the IH -44 /US 287 elevated
expressway; and,
WHEREAS, plans for this project require right -of -way easements be granted to
the State on both the Broad and Holliday sides of Harold Jones Park and at the corner
of Sixth and Broad at Memorial Auditorium.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City of Wichita Falls shall grant the following right -of -way
easements located in Wichita Falls, Wichita County, Texas to the State of Texas for the
IH -44 Elevated Project:
Site
Parcel # 11 E: A 0.555 acre tract out of Lots 1 and 2, Block 238, Original Town
Parcel # 15E: A 0.259 acre tract out of Block 247, Original Town Site
Parcel #16E: A 0.228 acre tract out of Block 247, Original Town Site
The above described parcels being fully described by metes and bounds in field
surveys prepared by Corbett, Probst & Boyd Inc., in July 1997.
SECTION 2. The State of Texas shall pay the City of Wichita Falls the fair
market value of the above described tracts as determined in appraisals prepared by
Henderson Appraisal and Consultants, who were employed by the State to appraise
the takings. The appraised values are as follows:

SECTION 3. The Honorable Kay Yeager, Mayor of the City of Wichita Falls, is
hereby authorized to execute the right -of -way easements conveying these parcels to
the State of Texas.
SECTION 4. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
