RESOLUTION TO APPROVE REVISED WATER PURCHASE
CONTRACT WITH DEAN DALE WATER SUPPLY CORPORATION;
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City and Dean Dale Water Supply Corporation (Dean Dale)
entered into a Water Purchase Contract on March 2, 1977'and since have mutually
agreed to fourteen amendments as well as a Memorandum of Agreement on rate
setting principles; and
WHEREAS, Dean Dale now is in need of additional water supplies to serve the
City of Byers and Community of Charlie; and
WHEREAS, Dean Dale has asked the City to amend the contract terms; and,
WHEREAS, a new contract has been prepared to incorporate all previous
agreements and to incorporate the Dean Dale request for an extended service area and
an increase in the water supplied; and,
WHEREAS, the Council has examined and considered a proposed contract for
the purposes stated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The proposed Water Purchase Contract between the City and
Dean Dale is hereby approved, and the City Manager is authorized to execute the
contract on behalf of the City.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law
PASSED AND APPROVED this the 1 st day of December, 1998.
