Res 171-98 12/1/1998RESOLUTION NO. 41 RESOLUTION AUTHORIZING AN AGREEMENT WITH CONCRETE HOMES, INC. TO FACILITATE THE CONDITIONS FOR THE SALE OF CITY OWNED PROPERTY FOR THE CONSTRUCTION OF NEW HOUSING AND TO AUTHORIZE THE SALE OF PROPERTY AT 1006 NEFF (LOT 12, BLOCK 5, HOMEWOOD HEIGHTS); DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls has established a Housing Initiative program for reinvestment in the Wichita Falls -East area ; and WHEREAS, Concrete Homes, Inc. ( "the Contractor') is prepared to construct new homes in the area, beginning with a home for sale at 1006 Neff St.; and WHEREAS, this agreement has been facilitated by the establishment of the Housing Initiative Program under Community Development Block Grant Program and the HOME Program; and WHEREAS, it is in the best interest of the City to facilitate area development and potential housing opportunities for low and moderate income home buyers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to execute an Agreement with the Contractor to facilitate the conditional sale of City -owned properties. SECTION 2 The City Manager is hereby authorized to execute documents to complete the sale of property at 1006 Neff St. (Lot 12, Block 5, Homewood Heights) Wichita Falls, Texas to Concrete Homes, Inc. SECTION 3. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. Fillmore St. Amarillo, Texas 79110 RE: AGREEMENT FOR TRANSFER OF PROPERTY The City of Wichita Falls agrees to donate the property at 1006 Neff Street (Lot 12, Block 5, Homewood Heights), Wichita Falls, Texas to Concrete Homes Inc. This property is to be used exclusively for the construction of low- to moderate - income, single - family residence. If the residence is purchased by a household that does not meet the Community Development Block Grant income requirements Concrete Homes Inc. will reimburse the cost of recording, surveying and paying back taxes the City incurred during acquisition of the property. Reimbursement to the City shall be made at the time of closing with the buyer /homeowner. Construction must commence within six months and be completed with;ii one year of the title transfer or ownership will revert back to the City. Concrete Names Inc. agrees to abide by all City of Wichita Falls ordinances including but not limited to zoning and building regulations.
