RESOLUTION TO APPROVE AGREEMENT WITH TEXAS
DEPARTMENT OF TRANSPORTATION TO CONTRIBUTE FUNDS FOR
THE RELOCATION OF UTILITIES FOR THE OVERHEAD
EXPRESSWAY PROJECT ; DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls is participating with the Texas Department
of Transportation for the construction of an Overhead Expressway; and
WHEREAS, a number of utility relocations must be made to facilitate
construction of the expressway; and
WHEREAS, some relocations will be fully funded by the Federal Government
while others will be partially funded by the State of Texas; and
WHEREAS, those relocations with partial State funding require 10% contribution
by the City of Wichita Falls, and those relocations without State funding call for a 100%
contribution by the City of Wichita Falls for the construction cost; and
WHEREAS, TXDOT is requesting the City place an estimated amount of the
10% contribution in escrow, set amount to be adjusted based on the construction cost
when the project is complete; and,
WHEREAS, TXDOT has asked the City to enter into an Agreement for the
contribution of funds for those state purposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Council has examined the proposed Agreements to contribute
funds, and the Agreements are hereby approved with the authority for the City Manager
to make an escrow payment of $35, 568.10.
SECTION 2. It is hereby officially found and determined that the meeting at
which this Resolution was passed was open to the public as required by law
PASSED AND APPROVED this the 17th day of November, 1998.
