Res 164-98 11/17/1998RESOLUTION NO. RESOLUTION TO ACCEPT THE HAMILTON PARK TENNIS COURTS #9 AND #10 RECONSTRUCTION PROJECT AND AUTHORIZE FINAL PAYMENT TO DUKE CONSTRUCTION; DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls entered a lump sum price contract with Duke Construction with an estimated total cost of $57,990.00; and WHEREAS, one change order was approved in the course of the work, increasing the estimated contract cost to $66,490.00; and WHEREAS, the actual work was completed at a total cost of $66,490.00 of which $61,998.69 has been previously paid to the contractor; and WHEREAS, the Contractor incurred 22 days of liquidated damages at $160.00 per day; leaving an amount due of $971.31; and WHEREAS, the City staff has inspected the work and found it to be acceptable. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The Hamilton Park Tennis Courts #9 and #10 Reconstruction Project is hereby accepted, and the City Manager is authorized to make final payment to the contractor. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law PASSED AND APPROVED this the 17th day of November, 1998.
