RESOLUTION APPROVING AN AMENDMENT TO THE CONTRACT
WITH BIGGS AND MATHEWS, INC. FOR THE DEVELOPMENT OF A
GROUND WATER MONITORING AND SAMPLING PROGRAM;
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Part 258.51 of 40 CFR requires that a ground water monitoring
system be installed at Type I Sanitary Landfills; and
WHEREAS, the City of Wichita Falls Type I Landfill has unique geological
conditions that would suggest a potential for modified ground water monitoring program
approval; and
WHEREAS, in negotiating the ground water monitoring and sampling
requirements, an additional task became necessary to address TNRCC requirements;
and
WHEREAS, the City of Wichita Falls desires to amend the contract to include the
additional costs required by the requirements of the Texas Natural Resource
Conservation Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The contract between Biggs & Mathews, Inc. for the development
of the Ground Water Monitoring and Sampling Program for the City of Wichita Falls
Type I Sanitary Landfill (Permit No. 1428) is hereby amended to include additional cost
of $7,600.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law
