RESOLUTION TO ACCEPT THE 1998 STREET RESURFACING
PROJECT AND AUTHORIZE FINAL PAYMENT TO ZACK BURKETT
COMPANY; DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with Zack
Burkett Company with an estimated total cost of $507,635.80; and
WHEREAS, two Change Orders were approved in the course of the work,
increasing the estimated amount to $521,075.80; and
WHEREAS, the total work done is $516,181.91 of which $509,961.29 has been
previously paid to the Contractor leaving an amount due of $6,220.62; and
WHEREAS, the City staff has inspected the work and found it acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The 1998 Street Resurfacing Project is hereby accepted and the
City Manager is authorized to make final payment to the Contractor.
SECTION 2 It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law
PASSED AND APPROVED this the 19th day of January, 1999.
