RESOLUTION TO APPROVE REVISED WATER PURCHASE
CONTRACT WITH FRIBERG- COOPER WATER SUPPLY
CORPORATION; DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City and Friberg- Cooper Water Supply Corporation entered into
a Water Purchase Contract on June 15, 1979 and since have mutually agreed to nine
amendments as well as a Memorandum of Agreement on rate setting principles; and
WHEREAS, Friberg- Cooper now is in need of additional water supplies to
replace their nitrate contaminated well water; and
WHEREAS, Friberg- Cooper has asked the City to amend the contract terms; and
WHEREAS, a contract amendment has been prepared to incorporate an
increase in the water supplied; and
WHEREAS, the City Council has examined and considered a proposed contract
amendment for the purposes stated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The proposed amendment to the Water Purchase Contract
between the City and Friberg- Cooper is hereby approved, and the City Manager is
authorized to execute the contract on behalf of the City.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
