Res 052-99 5/4/1999RESOLUTION NO. RESOLUTION AUTHORIZING AN AGREEMENT WITH CALBERT DEVELOPMENT COMPANY TO FACILITATE THE CONDITIONS FOR THE SALE OF CITY -OWNED PROPERTY FOR THE CONSTRUCTION OF NEW HOUSING AND TO AUTHORIZE THE SALE OF PROPERTY AT 817 AND 819 ROOSEVELT STREET; DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls has established a Housing Initiative Program for reinvestment in the Eastside of Wichita Falls; and WHEREAS, Calbert Development Company ( "the Contractor') is prepared to erect a manufactured home in the area, beginning with a home for sale at 817 and 819 Roosevelt Street; and WHEREAS, it is in the best interest of the City to facilitate area development and potential housing opportunities for low and moderate income home buyers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to execute the attached agreement for the transfer of property and a special warranty deed to convey title on the following property located in Wichita Falls, Wichita County, Texas to Calbert Development Company, P.O. Box 4147, Wichita Falls, Texas. 817 and 819 Roosevelt Street Lots 13 and 14, Block 4, Homewood Heights Addition SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 4th day of May, 1999. Box 4147 Wichita Falls, Texas 76308 Re: AGREEMENT FOR TRANSFER OF PROPERTY The City of Wichita Falls agrees to donate the following property to Calbert Development Company: 817 and 819 Roosevelt Street Lots 13 & 14, Block 4, Homewood Height Addition This property is to be used exclusively for the construction of a low- to moderate - income, single family residence. If the residence is purchased by a household that does not meet the Community Development Block Grant income requirements, Calbert Development Company will reimburse the cost of recording and paying back taxes the City incurred during acquisition of the property. Reimbursement to the City shall be made at the time of closing with the buyer /homeowner. Construction must commence within six months and be completed within one year of the title transfer or ownership will revert back to the City. Calbert Development Company agrees to abide by all City of Wichita Falls ordinances, including but not limited to zoning and building regulations.
