RESOLUTION ESTABLISHING THE ANNUAL RENTAL RATE FOR 142
LEASE LOTS AT LAKE KICKAPOO, CURRENTLY UNDER A $385.00
LEASE AGREEMENT ESTABLISHED ON MAY 17, 1994, FOR A FIVE
YEAR PERIOD BEGINNING ON OCTOBER 1, 1999 THROUGH
SEPTEMBER 30, 2004; DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council approved a second generation lease agreement for
142 lots at Lake Kickapoo on May 17, 1994; and
WHEREAS, Section 3 of the agreement designates a five year review and
adjustment of the annual rental rate to bring the lease rental payments in accord with
the Lake Kickapoo lot lease rental rate in effect at the time the adjustment is made, not
to exceed 30% of the rate in effect the preceding five year period; and
WHEREAS, the current rental rate of $385.00 is set to expire on these leases as
of September 30, 1999.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The annual rental rate for lease lots at Lake Kickapoo, currently
leased for $385.00 shall increase to $462.00 per year for the next five year period
beginning October 1, 1999 through September 30, 2004.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
