RESOLUTION TO APPROVE CHANGE ORDER NO. 3 AND ACCEPT
THE PAINTING OF PUCKETT TOWER AND CYPRESS '87 CLARIFIERS
PROJECT AND AUTHORIZE FINAL PAYMENT TO TELCOM OF TEXAS,
INC.; DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a lump sum contract price with
Telcom of Texas, Inc. with an estimated total cost of $337,000; and
WHEREAS, two Change Orders were approved in the course of the work
increasing the estimated cost to $358,364; and
WHEREAS, the approval of Change Order No. 3 will increase the cost to
$360,864 of which $342,820.80 has been previously paid to the contractor; and
WHEREAS, the contractor incurred 38 days of liquidated damages at $240 per
day, leaving an amount due of $8,923.20; and
WHEREAS, the City staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Change Order No. 3 is approved and the Painting of Puckett Tower
and Cypress '87 Clarifiers Project is hereby accepted, and the City Manager is
authorized to make final payment to the contractor
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law
PASSED AND APPROVED this the 5th day of January, 1999.
