(:Di - 6i°j RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING AN ADJUSTMENT OF FEES AND FINAL PAYMENT FOR CERTAIN SERVICES FOR THE MULTI- PURPOSE EVENTS CENTER COLISEUM; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, on November 17, 1992, the Wichita Falls City Council, by adoption of Resolution 174 -92, approved contracts with the MPEC Coliseum Joint Venture, MPEC Site Joint Venture, and the MPEC Coordinating Architect for certain work related to the construction of a new coliseum; and, WHEREAS, it is the desire of the Wichita Falls City Council that said contracts be continued and progress made toward the construction of a coliseum. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Payment to the MPEC Coliseum Joint Venture in the amount of $88,516 is authorized as final and complete payment for architectural services for the Programming and Schematic Design Phase, Design Development Phase, and the Construction Document Phase. SECTION 2. Payment to the MPEC Coordinating Architect in the amount of $10,245 is authorized as final and complete payment for architectural services for the Programming and Schematic Design Phase, Design Development Phase, and Construction Document Phase. SECTION 3. The hourly rates of the MPEC Coliseum Joint Venture, the MPEC Coordinating Architect and the MPEC Site Architect as additional services are approved per the attached letters in Exhibit A. Payment in an amount not to exceed $36,300 is authorized for the review of all the coliseum plans and documents. SECTION 4. The assignment of the MPEC Site Joint Venture Contract to Secord and Lebow Architects, Inc., is approved. SECTION 5. The City Manager is authorized to execute documents necessary to accomplish the purpose of this resolution. SECTION 6. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 17th day of August 1999.
