RESOLUTION AUTHORIZING AN AGREEMENT WITH PROGRESSIVE ECONOMIC OPPORTUNITY PROGRAMS FOR LOCAL EFFORTS TO FACILITATE THE CONDITIONS FOR THE TRANSFER OF CITY - OWNED PROPERTY AT 1006 NEFF STREET AND 821 ROOSEVELT STREET FOR THE CONSTRUCTION OF NEW HOUSING AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE DEEDS TO TRANSFER TITLE; DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, in accordance with Chapter 272.001 of the Texas Local Government Code, the City of Wichita Falls may convey property, without the solicitation of bids, to non - profit entities for economic development programs authorized by Title I of the Housing and Community Development Act; and WHEREAS, Progressive Economic Opportunity Programs for Local Efforts desires to construct homes for the benefit of qualified low- to moderate- income families. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to execute the attached agreement for the transfer of property and a special warranty deed to convey title on the following properties located in Wichita Falls, Wichita County, Texas to Progressive Economic Opportunity Programs for Local Efforts. 1006 Neff Street Lot 12, Block 5, Homewood Heights Addition 821 Roosevelt Street Lot 12, Block 4, Homewood Heights Addition SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 3'0 day of August, 1999. ATTEST: City Clerk 1--," 1 /'6 MAYO CITY OF WICHITA FALLS, TEXAS Progressive Economic Opportunity Programs for Local Efforts (P.E.O.P.L.E.) 401 Madison Street Wichita Falls, Texas 76304 Re: AGREEMENT FOR TRANSFER OF PROPERTY The City of Wichita Falls agrees to donate the following property to P.E.O.P.L.E.: 1006 Neff Street Lot 12, Block 5, Homewood Heights Addition 821 Roosevelt Street Lot 12, Block 4, Homewood Heights Addition These properties are to be used exclusively for the construction of a low- to moderate - income, single family residences. Construction must commence within six (6) months from the transfer of title on the above described properties. P.E.O.P.L.E. agrees to abide by all City of Wichita Falls ordinances including, but not limited to, zoning and building regulations. Should construction fail to commence within six (6) months or the properties be used for purposes other than those previously stated, ownership will revert back to the City.
