Resolution approving Amendment No. 3 to the Construction Manager at
Risk services contract with Trinity-Hughes/Sundt Joint Venture for the
construction of the Wichita Falls Regional Airport Terminal Area Project
(City of Wichita Falls — SPS Airport Terminal), and authorizing the City
Manager to execute all documents necessary to approve trade contractors
and subcontractors in accordance with Chapter 2267 of the Texas
Government Code
WHEREAS, the City Council finds that the City Staff has validly used the procedures
described in Chapter 2267 of the Texas Government Code to obtain construction manager at
risk services for the construction of the Wichita Falls Regional Airport Terminal Area Project
and complied with other statutory provisions related thereto;
WHEREAS, November 20, 2012, the City Council awarded a contract to Trinity-
Hughes/Sundt Joint Venture to serve as the Construction Manager at Risk for construction of
Phase II and Phase III of the Wichita Falls Terminal Area Project; and
WHEREAS, as part of that contract, Trinity-Hughes/Sundt Joint Venture prepared and
submitted a Guaranteed Maximum Price in Amendment #2 to City Council on September 17,
2013 for $21,915,583.
WHEREAS, the City Council desires to amend the guaranteed maximum price
contract with Trinity-Hughes/Sundt Joint Venture by an additional $6,221,520 for construction
work to complete the passenger terminal building and identified facilities.
WHEREAS, Amendment #3 increases the guaranteed maximum price contract with
Trinity-Hughes/Sundt to $28,137,103.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The City Manager is authorized to execute the attached GMP No. 3 (Amendment No.
3), authorizing a Guaranteed Maximum Price of $28,137,103 in the Construction Manager at
Risk Services Contract with Trinity-Hughes/Sundt Joint Venture for the construction of the
Wichita Falls Regional Airport Terminal Area Project (City of Wichita Fall - SPS Airport
Terminal), with changes as approved by the City Attorney, and the City Manager is further
authorized to execute all documents necessary to complete the work including all documents
necessary to approve trade contractors and subcontractors for this project, in accordance
with Chapter 2267 of the Texas Government Code.

3. THE PROJECT SCHEDULE IS BASED UPON THE DOCUMENT INCLUDED WITHIN THIS GMP. THE TIME AND COST RELATING TO THIS
GMP IS AN ADDITIONAL 5 MONTHS FROM THE ORIGINAL PACKAGE 2 SUBSTANTIAL COMPLETION DATE TO INCORPORATE THE
DEMOLITION OF THE EXISTING TERMINAL AND ANY WORK RELATING TO IT.
4. NO TESTING LAB SERVICES OR SPECIAL INSPECTIONS ARE INCLUDED AS PART OF THIS GMP. FOR ITEMS CALLED OUT IN THE
SPECIFICATIONS AND/OR ADDENDA,ONLY COORDINATION,ACCESS AND SUPPORT WILL BE PROVIDED.
�. GENERAL CLARIFICATIONS
a) THIS GMP INCLUDES NO ADDITIONAL MONIES FOR REPAIR OF EXISTING ROADWAY,/DRIVES NOT DIRECTLY
AFFECTED BY NEW CONSTRUCTION.ALL ROADWAYS ARE ASSUMED TO BE OF SUFFICIENTLY DESIGNED AND IN GOOD
CONDITION TO ACCEPT THE TRAFFIC OF A CONSTRUCTION PROJECT OF THIS NATURE.THE TRAFFIC WILL INCLUDE
BUT NOT BE LIMITED TO FULLY LOADED CONCRETE TRUCKS,FULLY LOADED DUMP TRUCKS,FULLY LOADED STEEL.
TRUCKS AS WELL AS OTHER ASSORTED CONSTRUCTION EQUIPMENT AND VEHICLE TRAFFIC.
b) NO MONIES ARE INCLUDED IN THE GMP FOR UTILITY FEES.ALL UTILITY CONNECTION FEES PAID BY TRINITY
HUGHES/SUNDT WILL BE REIMBURSED AT A RATE OF 100%OFTHE ACTUAL COST.
C) NO MONIES ARE INCLUDED IN THE GMP FOR ANY PERMIT FEES.
d) WHILE THIS PROJECT HAS BEEN DESIGNED TO BE A SUSTAINABLE FACILITY THIS IS NOT A LEE PROJECT. LEED
DOCUMENTATION AND SUBMITTALS CALLED FOR IN THE SPECIFICATIONS WILL NOT BE PROVIDED.
e] AS THE PROJECT HAS LOST ACCESS TO ONSITE WATER SERVICE,WATER FOR CONSTRUCTION WILL BE TRANSPORTED
TO THE SITE WITH ONE EXCEPTION. WATER FOR THE ONSITE CONCRETE BATCH PLANT IS BASED ON USING A CITY
METER AS THE BATCH PLANT 15 A FACILITY.
f) THE'FINAL PROPERTY SURVEY CALLED FOR IN SECTION 01-73-00 IS NOT INCLUDED AS PART OF THIS GMP.
g) ALL OWNER SUPPLIED CONTRACTOR INSTALLED MATERIALS ARE ASSUMED TO BE OF SUFFICIENT QUALITY AND
QUANTITY FOR WORK AS INDICATED IN THE CONTRACT DOCUMENTS.
h) THIS GMP IS BASED ON PERFORMING PHASE 1 AND PHASE 2 OF THE AIRSIDE DOCUMENTS SIMULTANEOUSLY.
I) THE ENTIRE AIRSIDE WORK AREA WILL BE ENCLOSED BY TEMPORARY ADA FENCING TO CREATE A NON-SECURE
WORKSITE. THIS GMP DOES NOT INCLUDE THE REQUIREMENTS OF WORKING ON AN ACTIVE AIRFIELD AS DEFINED
ON SHEET G-0003 OTHER THAN THE FENCING INSTALLATION.
