Ord 18-2014 5/6/2014 ORDINANCE NO. 18-2014 Ordinance abandoning approximately 1,161 square foot of utility easement behind 4923 Lake Park Drive, subject to the dedication of an 801 square foot and a 411 square foot utility easement in the front of 4923 Lake Park Drive WHEREAS, Pat Canan, with Lake Park Resources, LLC, the owners of 4923 Lake Park Drive, has requested the City abandon the utility easement located behind said property between Lake Park Drive and Southwest Parkway; WHEREAS, all affected City departments and utility companies have reviewed this request and have recommended conditional approval to abandon this utility easement, subject to all utilities being relocated at the expense of the property owner; and WHEREAS, it has been determined to be in the best public interest to abandon said utility easement as herein indicated on the attached Abandoned Easement Survey and Abandoned Easement Field Notes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. An approximately 1,161-square foot portion of the utility easement located behind 4923 Lake Park Drive, described above and depicted in the attached Abandoned Easement Survey, is hereby abandoned, subject to any and all utilities therein being the relocated at the expense of the property owner and the property owner’s dedication of an 801 square foot and a 411 square foot utility easement in the front of 4923 Lake Park Drive as depicted in the attached Easement Dedication Survey. 2. The City Manager is authorized to execute all documents necessary to complete the utility easement abandonment and utility easement dedication, in a form to be approved by the City Attorney.
