Ord 110-87 11/3/1987 . Ordinance No. 110 -87 AN ORDINANCE AMENDING CERTAIN SECTIONS OF ORDINANCE 17-87, FLOOD DAMAGE PREVENTION ORDINANCE, EXEMPTING PLACEMENT OF MANUFACTURED HOMES IN EXISTING MANUFACTURED HOME PARKS OR SUBDIVISIONS FROM THE REQUIREMENTS OF THE ORDINANCE. WHEREAS, the Federal Emergency Management Agency (FEMA) has suspended the National Flood Insurance Program (NFIP) regulations regarding placement of manufactured homes placed in existing manufactured homes and subdivisions; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to exempt placement of manufactured homes in existing manufactured homes and subdivisions from the requirements of the flood damage prevention ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Article 2 of Ordinance No. 17-87 which amended Chapter 152 of the Wichita Falls Code of Ordinances is hereby amended by adding alphabetically the following definitions: "EXISTING MANUFACTURED HOME PARK OR SUBDIVISION - means a manufactured home park for which the construction of facilities for servicing the lot on which the manufactured homes are to be affixed ( including, at a minimum, the installation of utilities, either final site grading or the pouring of concrete pads, and the construction of streets) are completed before the effective date of floodplain management regulations adopted by a community. "EXPANSION TO AN EXISTING MANUFACTURED HOME PARK OR SUBDIVISION - means the preparation of additional sites by the construction of facilities for servicing the lots on which the manufactured homes are to be affixed ( including the installation of utilities, either final site grading or pouring of concrete pads, or the construction of streets) . " SECTION 2. Article 5, Section B, ( 4) of Ordinance 17-87 which amended Chapter 152 of the Wichita Falls Code of Ordinances is hereby amended to read as follows: "4) Manufactured Homes - a. Require that all manufactured homes to be placed within Zone A, shall be installed using methods and practices which minimize flood damage. For the purpose of this requirement, manufactured homes must be elevated as required by Section B( 4) (c) of this Article, and anchored to resist flotation, collapse, or lateral movement. Methods of anchoring may include, l v • but are not limited to, use of over-the-top or frame ties to ground anchors. This requirement is in addition to applicable State and local anchoring requirements for resisting wind forces. b. All manufactured homes that are required to be elevated by Sec. ( 4) (c) of this Article shall be in compliance with Article 5, Section B( 1) . c. Require that all manufactured homes to be placed or substantially improved within Zones Al-30, AH, and AE on the community' s FIRM be elevated on a permanent foundation such that the lowest floor of the manufactured home is at or above the base flood elevation; and be securely anchored to an adequately anchored foundation system in accordance with the provisions of Section B( 4) of this Article. This paragraph applies to manufactured homes to be placed or substantially improved in an expansion to an existing manufactured home park or subdivision. This paragraph does not apply to manufactured homes to be placed or substantially improved in an existing manufactured home park or subdivision except where the repair, reconstruction, or improvement of the streets, utilities and pads equals or exceeds 50 percent of the value of the streets, utilities and pads before the repair, reconstruction or improvement has commenced. " SECTION 3. Section E( 1) , Article 5 of Ordinance 17-87 which amended Chapter 152 of the Wichita Falls Code of Ordinances is hereby amended to add the following sentence to the end of the paragraph: "This section of the ordinance shall not apply to the place- ment of manufactured homes in existing manufac ured home parks or subdivisions.
