ORDINANCE NO. //647
ORDINANCE AMENDING ORDINANCE NO. 103-87, WHICH
PROHIBITED SMOKING IN CERTAIN PUBLIC PLACES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Subsection 1. 2 of Ordinance No. 103-87 is hereby
amended to read as follows:
"1. 2 'Restaurant' means any food establishment, open
to the general public, where food is served for consumption by
seated customers. "
SECTION 2. Paragraph 3. 2. 1 of Ordinance No. 103-87 is
hereby amended to read as follows:
"3 . 2.1 Such non-smoking area shall be situated so that
ventilation minimizes the effect of smoke from adjacent smoking
areas, and so that air from the smoking area is not drawn into or
across the non-smoking area. "
SECTION 3 . Section 5 of Ordinance No. 103-87 is hereby
amended to read as follows:
"SECTION 5. Smoking in hospitals.
Smoking is prohibited in all areas in hospitals,
except by a patient in a designated private patient room or, if
both are smokers, the patients in a designated semi-private
patient room, and except in separate enclosed designated smoking
areas. "
SECTION 4. This ordinance is declared to be an emergency
measure, and it shall become effective on the same date that
Ordinance No. 103-87 becomes effective.
